By accessing or using the Website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Website. These Terms apply only to the Website and do not replace any separate written agreement concerning the purchase, warranty, service, or ownership of a Bertram product.

The Website and its content—including text, photographs, video, graphics, designs, logos, trademarks, product names, software, and other materials—are owned by or licensed to Bertram and are protected by intellectual-property laws.

Bertram grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Website for lawful personal and informational purposes. No ownership rights are transferred. You may not use Bertram names, logos, or marks without prior written permission. All rights not expressly granted are reserved.

Website content is provided for general information. Product specifications, dimensions, performance figures, features, colors, equipment, options, pricing, and availability may change without notice and may vary by model, model year, configuration, or location. Photographs and renderings may show optional equipment or features that are not included as standard.

You may separately and voluntarily consent to receive marketing email, marketing text messages, or both. Neither choice is required to submit an inquiry or purchase a product or service. You may unsubscribe from marketing email using the link provided in an email.

If you opt in to SMS, Bertram may send recurring marketing text messages concerning products, inquiry follow-ups, events, and related updates. Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to opt out. Consent is not a condition of purchase. Carriers are not liable for delayed or undelivered messages.

Email and SMS preferences are separate. Withdrawing consent from one channel does not automatically withdraw consent from the other. Our collection and use of communication information is governed by our Privacy Policy.

If you submit comments, photographs, testimonials, ideas, feedback, or other content to Bertram, you represent that you have the necessary rights to do so and that the submission does not violate law or another person’s rights.

Bertram does not warrant that the Website will be uninterrupted, error-free, secure, or free from viruses or other harmful components. Nothing on the Website is professional, legal, financial, navigational, safety, or operational advice. Product operation and safety are governed by applicable manuals, warnings, training, and written product documentation.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BERTRAM AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO THE WEBSITE OR THESE TERMS.
